As long as it was the exact same disc, and it was installed while connected, key point, they still maintain control knowing that if the disc is in your possession, they can prove it hasn't been sold yet. You still need internet for the install, but a loss of internet subsequently should be doable. Meanwhile, all the DL games you own should be fine too as they aren't tied to a code on a disc somewhere. They could do it, and might have to.
Well, if the discs have a unique code on them to identify the individual disc, and the game was installed while connected to the internet, there should be no excuse for not being able to authenticate off of the disc in the event internet is out for awhile. The installed game will just check the code on the disc to make sure you haven't sold it yet. That should be proof enough. MS needs to solve this one technical hurdle IMO.
